Terms of Use

This document is a template prepared for LocumHire and is pending review by a qualified solicitor. It reflects how the platform operates but should not be relied on as legal advice.
1. Who we are
LocumHire ("LocumHire", "we", "us") operates www.locumhire.co.uk, an online marketplace that connects UK pharmacies with GPhC-verified locum pharmacists and pharmacy technicians. You can contact us at info@locumhire.co.uk.
2. These terms
These terms govern your use of the platform, whether you register as a pharmacy or as a locum. By creating an account you agree to them. We may update these terms from time to time; if a change materially affects you, we will notify you by email or when you next sign in. Continued use of the platform after a change takes effect means you accept the updated terms.
3. What LocumHire is — and is not
LocumHire is an introduction platform. We provide the tools for pharmacies to post shifts, for verified locums to apply, and for both sides to manage bookings, records, and invoices in one place.
The engagement is between you. When a pharmacy books a locum, the contract for that shift is formed directly between the pharmacy and the locum. We are not the employer of any locum, we are not a party to the engagement, and we do not supervise the work performed on a shift.
Money flows directly. The pharmacy pays the locum the full posted rate directly. LocumHire never holds, collects, or releases a locum's pay. The only amount we invoice is our placement fee (see section 7).
4. Accounts and eligibility
You must be at least 18 and able to enter into a binding contract. You agree to provide accurate, current information when registering and to keep it up to date, to keep your sign-in credentials secure, and to maintain only one account. Tell us promptly if you suspect unauthorised use of your account. We may suspend or close accounts that breach these terms, provide false information, or are used fraudulently.
5. Locum obligations
As a locum you agree that you will:
- hold valid, current GPhC registration appropriate to the roles you apply for, and complete our verification process before applying to shifts;
- have the legal right to work in the United Kingdom;
- attend shifts you have accepted, arrive punctually, and perform them with reasonable skill and care, in line with GPhC standards for pharmacy professionals;
- maintain appropriate professional indemnity insurance;
- account for your own tax and National Insurance — you engage with pharmacies as an independent professional, not as an employee of LocumHire.
6. Pharmacy obligations
As a pharmacy you agree that you will:
- post shift details that are accurate — including times, hourly rate, unpaid breaks, and any requirements — and honour the posted rate;
- provide a safe, lawful working environment for booked locums;
- pay the locum the full posted rate directly and promptly after the shift completes — payment of the locum is your obligation, not ours;
- as the engaging party, determine and meet any employment-status obligations that apply to the engagement (including off-payroll working / IR35 assessments where relevant);
- use information about locums only for the purpose of the engagement.
7. Fees and invoicing
Registration is free for both sides. Posting shifts is free, and applying to shifts is free. Locums are never charged and no percentage is ever deducted from a locum's rate.
When a shift completes, we invoice the pharmacy a fixed placement fee — one flat price per completed shift, never a percentage of the shift value. The current fee is shown to the pharmacy before a shift is posted. Invoices are payable within 7 days. Late payment may incur a late-payment uplift, as stated on the invoice. Fees are exclusive of VAT, which is added where applicable. Shifts cancelled before their start time are not invoiced.
8. Cancellations, no-shows and disputes
Either party may cancel a booking before the shift starts; we ask that this is done as early as possible. Repeated late cancellations or failures to attend may lead to account suspension. If something goes wrong with a shift, either party should raise a dispute through the in-app dispute flow; we will review disputes reasonably and may pause related invoicing while a dispute is open. Our role in a dispute is administrative — it does not make us a party to the engagement.
9. Acceptable use
You agree not to:
- post content that is unlawful, misleading, defamatory, or infringes anyone's rights;
- use the platform to identify counterparties and then repeatedly arrange equivalent engagements off-platform in order to avoid the placement fee;
- scrape, copy, or resell platform content or data;
- interfere with the operation or security of the platform.
10. Intellectual property
The platform, its design, and its content (other than content you submit) belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You retain rights in the content you submit and grant us a licence to host and display it as needed to operate the platform.
11. Data protection
How we handle personal data is described in our Privacy Policy and Cookie Policy. Where a pharmacy receives personal data about a locum through the platform, it must handle that data in accordance with UK data protection law.
12. Liability
The platform is provided on an "as is" basis. We do not guarantee that shifts will be filled, that applicants will be suitable, or that the platform will be available without interruption. Because shift engagements are contracts between pharmacies and locums, we are not liable for the acts or omissions of either party to an engagement, including non-attendance, performance on shift, or non-payment of a locum by a pharmacy.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our total aggregate liability to you in any 12-month period is limited to the fees you paid to us in that period (or £100 if you have paid no fees).
13. Suspension and closing your account
You may close your account at any time. We may suspend or close accounts for breach of these terms, for legal or regulatory reasons, or where verification cannot be completed. Obligations that accrued before closure — including outstanding invoices — survive it.
14. General
If any part of these terms is found unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver of it. You may not transfer your rights under these terms without our consent. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute relating to them.
